eCRUSH Network Terms of Service and Use Agreement

Please read the following Terms of Service and Use Agreement ("Agreement"). When you use the eCrush.com, eSpin-The-Bottle.com or Surveys4Teen.com (the "Sites" of the "eCRUSH Network") or sign up for any services within the eCrush.com, eSpin-The-Bottle.com or Surveys4Teen. websites (the "Services" of the eCRUSH Network), you agree to all of the terms and conditions of this Agreement and the terms of our Privacy Policy, whether or not you register as an eCrush Network member. Please read the following terms and conditions carefully as well as the privacy policy, as they form the Agreement between you and eCrush.com, Inc. ("eCrush") with respect to your use of the Sites and Services.

IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU MAY NOT USE THE SITES AND SERVICES, AND SHOULD NOT PROCEED TO REGISTER FOR ANY SUCH SERVICES. BY REGISTERING FOR THE SERVICES YOU BECOME AN ECRUSH NETWORK MEMBER ("MEMBER"), AND AGREE TO BE BOUND BY THE THIS AGREEMENT FOR AS LONG AS YOU ARE A MEMBER. IF YOU DO NOT AGREE WITH OR ACCEPT THESE TERMS AND CONDITIONS, YOU SHOULD EXIT THE ECRUSH.COM, ESPIN-THE-BOTTLE OR SURVEYS4TEEN.COM ACCOUNT REGISTRATION TEMPLATE AND NOT USE THE SITES.

1.0 REGISTRATION AND ACCEPTANCE

1.1 Age of Consent. By using the Sites and/or registering for the Services Member represents and warrants that he or she is 13 years of age or older. If Member registers as an adult they represent and warrant that he or she is 18 years of age or older. By using the Sites and/or registering for the Services, you represent and warrant that you have the right, authority and capacity to enter this Agreement and to abide by all the terms and conditions of this Agreement. Membership in the Sites and Services is void where prohibited.

1.2 Term and Termination: This Agreement will remain in full force and effect as long as you use the Site and/or are a Member. You may terminate your membership at any time, for any reason, by discontinuing use of the Services or by following the instructions on the Resign pages in My Account, or upon receipt by eCrush of your written or email notice of termination.

eCrush may terminate this Agreement (i) automatically upon any violation or alleged violation of this Agreement or eCrush's Privacy Policy posted at http://www.ecrush.com/privacy.php, with or without prior notice to Member, at eCRUSH's sole discretion; (ii) at any time, for any reason, or no reason at all, with or without prior notice to Member, upon eCRUSH blocking of Member's access to the Site or Service, discontinuation of Member's account, and/or notification to Member at the e-mail address provided in Member's registration. Upon any termination by eCRUSH, Member shall discontinue any effort to access the eCRUSH Site or the Services.

2.0 USE OF MEMBER DATA

2.1 The Privacy Policy allows for Hearst to share or disclose personally identifiable information about you to other companies or individuals under a number of circumstances.

eCRUSH also maintains the right to share your information at our sole discretion.

3.0 MEMBER/USER CONDUCT

3.1 Member Name and Passwords. Member is solely responsible for maintaining the confidentiality of their member name and password. Member is responsible for all uses of their account, whether or not authorized by you. Member agrees to notify eCRUSH of any unauthorized use of their account. Member may not post or share any of the unlock codes associated with the eSPIN-the-Bottle premium upgrades.

3.2 Panels. If you decide to become a member of eCRUSH's survey panels, you may be shown confidential information as part of the surveys you take. The surveys may contain, but are not limited to, media content, unique techniques, sketches, drawings, or new products. In order to protect the integrity and confidentiality of our clients' research, it is a condition of membership that you agree not to reveal any information contained in surveys, and do not copy or distribute any graphics or other content from the surveys. Please be advised that legal action may be taken in the event stolen material is traced back to you.

3.3 Applicability of Guidelines. All judgments concerning the applicability of the guidelines set forth in this Agreement shall be in the sole and exclusive discretion of eCRUSHeCRUSH. reserves the right, but has no obligation, to monitor the materials posted by Members or the Services to enforce the guidelines set forth in this Agreement. Nor does eCRUSH guarantee that any monitoring it may perform will be to Member's satisfaction. Upon learning of any violation or alleged violation of this Agreement, eCRUSH, in its sole discretion, may (i) require Member to remedy such violation; (ii) partially or completely block access to Member's account; (iii) suspend or terminate Member's use of the Services; and/or (iv) take any other actions that eCRUSH deems appropriate to enforce its rights and pursue all available remedies.

3.4 You may not include in your public member profile any telephone numbers, street addresses, last names, URL's, and email/IM addresses.

4.0 Advice Columnists:

4.1 Advice. The Services or Sites may from time to time include messages from advice columnists who respond to relationship questions. Any statement made by advice columnists are provided for entertainment purposes only, and are not intended, and should not be taken, as specific advice in any particular circumstance. Such statements do not constitute counseling of any kind. Members with person problems or who may be seeking personal advice applicable to their personal situation, are urged to consult with a qualified counselor with respect to such issues.
